1. Our Commitment to Your Privacy

DME Medical Supplies & Complex Rehab Inc. is committed to protecting the privacy and security of your protected health information (PHI).

We provide durable medical equipment, medical supplies, complex rehabilitation technology, equipment evaluations, fittings, deliveries, repairs, replacements, and related services.

In providing these services, we may receive, create, maintain, use, or disclose health information about you.

We are required by law to maintain the privacy of your protected health information, provide notice of our legal duties and privacy practices, and notify affected individuals following a breach of unsecured protected health information when required by law.

This notice applies to protected health information maintained by DME Medical Supplies & Complex Rehab Inc., including applicable medical, equipment, service, and billing records.

2. How We May Use and Share Your Health Information

Treatment and Care Coordination

We may use or disclose your health information to coordinate equipment and services with your healthcare providers.

For example, we may communicate with physicians, physical therapists, occupational therapists, assistive technology professionals (ATPs), rehabilitation facilities, and other healthcare professionals to obtain prescriptions, verify medical necessity, coordinate evaluations, or arrange medically necessary equipment and related services.

Payment and Insurance Processing

We may use and disclose your health information to obtain payment for equipment and services.

This may include verifying benefits, requesting prior authorizations, submitting claims, processing payments, and resolving insurance denials.

For example, we may provide medical documentation to Medicare, Medicaid, or your insurance company to establish coverage or medical necessity for prescribed equipment.

Healthcare Operations

We may use and disclose your health information for permitted business operations, including quality improvement, compliance, audits, staff training, administrative functions, and evaluating the effectiveness of our services.

For example, we may review equipment delivery records and service documentation to improve patient care and operational performance.

Equipment Delivery, Maintenance, and Repairs

We may use your information to schedule equipment delivery, fitting, installation, maintenance, repair, or replacement.

Where legally permitted, we may share the minimum necessary information with manufacturers, vendors, contractors, or service providers involved in these activities. When a third party functions as our HIPAA business associate, we require appropriate contractual protections.

We will accommodate reasonable requests as required by law.

Request Restrictions

You may request limits on certain uses or disclosures of your information.

Receive an Accounting of Disclosures

You may request an accounting of certain disclosures made during the previous six years, subject to applicable exclusions and legal requirements.

Receive a Copy of This Notice

You may request a paper copy of this Notice of Privacy Practices at any time, even if you previously agreed to receive it electronically.

You may express preferences about sharing relevant information with family members, friends, caregivers, or others involved in your healthcare or payment for your care.

In a disaster relief situation, you may tell us your preference about whether we share your information with disaster relief organizations.

We will follow applicable HIPAA requirements when considering these preferences.

We generally must obtain your written authorization before:

You may revoke a written authorization at any time by notifying us in writing, except to the extent we have already acted in reliance on it or as otherwise permitted by law.

5. Communications With Patients

We may contact you by telephone or fax for legitimate treatment, payment, or healthcare operations purposes.

Such communications may include equipment orders, appointment coordination, delivery scheduling, repairs, service updates, insurance documentation, and billing matters.

We take reasonable steps to protect your information during communications and will accommodate reasonable requests for confidential communications as required by law.

6. Additional Protections for Sensitive Health Information

Some health records are subject to additional protections under federal or Florida law.

Substance Use Disorder Treatment Records

Certain substance use disorder treatment records are protected under 42 CFR Part 2.

When we receive or maintain records subject to Part 2, we will comply with applicable limitations on their use and disclosure.

Substance use disorder treatment records that we receive from programs subject to 42 CFR Part 2, or testimony relaying the content of those records, will not be used or disclosed in civil, criminal, administrative, or legislative proceedings against you unless you give written consent, or a court issues an order after you or the holder of the record has been given notice and an opportunity to be heard, as 42 CFR Part 2 provides. A court order authorizing such use or disclosure must be accompanied by a subpoena or other legal requirement compelling disclosure before the record is used or disclosed.

Other Sensitive Information

Other health information subject to additional legal protections will be handled according to applicable federal and Florida privacy requirements.

Redisclosure

Certain information disclosed to recipients outside HIPAA's protections may be redisclosed by those recipients and may no longer be protected by the HIPAA Privacy Rule. Other applicable laws, including restrictions involving Part 2 records, may continue to apply.
